Draft and Filed Land Use Applications

Draft land use applications should be prepared following the guidance discussed with DCP and as described in the Interdivisional Meeting Record.  

The Department will review a draft land use application only once per project and provide feedback in a comment letter or, as necessary, a working meeting with the applicant team, after which time the applicant will be guided to file the application when it is ready.   

Draft and Filed Land Use Applications should be submitted via  NYC Planning Applicants *, after consultation with the Lead Planner. 

Land use applications consist of:

  •   Land use application form  
  • Attachments that clearly describe the proposed land use actions and any development that may be facilitated by, or approved as, part of the proposed actions. Applicants may consider using the  Applicant Maps Tool  to produce some of the maps required as part of the land use applications. The tool makes the production of required maps less time consuming to prepare and eliminates the need for costly drafting or GIS software.

If you have questions regarding how to fill out forms or draft documents, review the online guidance and consult the assigned Lead Planner before submitting. Their responsibilities include ensuring applicants correctly understand how these documents should be completed.

Guidance on Submitting Attachments:

  • Attachments must be provided in PDF format as individual files for each attachment or section. Attachments will appear online alphabetically, so please use numbers to organize your filing and keep the names short and to the point. Example:  1. Project Description                 2. Official Zoning Map                 3. Tax Map
  • For especially large submissions, ZIP files may be used and subfolders may be appropriate to organize large sets of drawings (or in the case of EIS submissions a folder per chapter may be appropriate). Label folders to clearly identify contents.
  • Use the ‘Working Package’ , created by the Lead Planner, to save Doing Business with the City (DBA) Forms, Illustrative Drawings, back up documents for EAS/EIS, and any Word documents requested by the Lead Planner or EARD Lead.

Doing Business with the City Form

  • Homeowner applicants with actions concerning one, two, or three family dwellings.
  • Not for profit neighborhood, community or similar association applicants
  • City agency applicants without a private co-applicant

SDCI Customer Service Options

Most services are available online through our Virtual Applicant Services Center . For customers who need language assistance or technical assistance accessing the Virtual ASC, we have an SDCI information desk on the 4th floor of the Seattle Municipal Tower. What Is Land Use ?

In Seattle, the use of land (i.e. what you can do on private property) is regulated by the Land Use Code (Seattle Municipal Code (SMC) Title 23). The Land Use Code protects and promotes public health, safety, and general welfare. It does this through a set of regulations and procedures that implement the City's Comprehensive Plan . The Land Use Code establishes noticing procedures to promote informed public awareness of land use permit applications. The Land Use Code also establishes procedures for the coordination of review processes. The Land Use Code classifies land within the City into various zones and overlay districts to regulate uses and structures. The zoning regulations are designed to:

  • Provide adequate light, air, access, and open space
  • Conserve the natural environment and historic resources
  • Achieve a compatible scale between zones
  • Enhance the streetscape and pedestrian environment

The Code seeks to guide the efficient use of land with limited impact to the natural environment. The Code also directs development toward lots with adequate services and amenities that support the use. Other City regulations apply to development in Seattle, including Building and Construction Codes (SMC Title 22) and regulations for environmental review, critical areas, noise control, tree protection, and historic preservation (SMC Title 25).

We facilitate Master Use Permits from application intake to permit issuance. We conduct land use analyses and Land Use Code interpretations. A land use analysis can be requested through an opinion letter. The opinion letter describes SDCI's analysis of an issue relating to how the standards of the Land Use Code or related codes apply to a particular site, use of land, or development proposal. The Zoning Division conducts plan reviews and public hearings for Conditional Land Uses per the City of Detroit Zoning Ordinance.  Conditional Land Uses may be subject to developmental conditions resultant of the plan review process.  The Zoning Division also conducts historical research for the purpose of zoning verification.

Getting to the Finish Line

How to Obtain Site Plan Review Step 1. Check if your project requires Site Plan Review in  Section 50-3-113  of the Zoning Ordinance Step 2. Apply online for Site Plan Review. Complete the application and pay associated fees. Site Plan Review fee is $160.  Selecting the  PLANNING  tab Select  CREATE AN APPLICATION Select the record type  Hearings Select  Special Land Use Step 3. The Zoning Division will review your application & send your project to ProjectDox to review plans. Check your email for this confirmation. Step 4. Upload required documents & plans to ProjectDox. How to Schedule Special Land Use Hearings Special Land Use Hearings are required for uses that are "conditional" in the specific zoning district. Site Plan Review (SPR) is mandated by the City of Detroit Zoning Ordinance Chapter 61 in several specific instances including all Conditional Land Uses (Section 61-3-113). Depending on the zoning district, either the Planning and Development Department (P&DD) or City Council (through the City Planning Commission) has the power to review and approve site plans. BSEED is authorized to participate in the review process. To apply for SPR, three sets of properly dimensioned and drawn-to-scale Site, Floor, and Elevation Plans must be submitted along with the appropriate fee ($100.00 for Conditional Uses and $160.00 for all other uses) to the Plan Review Division, Room 409. Staff will review the plans for compliance with zoning, design, and operational requirements, typically within 10 days of receipt of a complete submission package. The applicant will be informed of necessary modifications, alterations, and/or improvements or, if the plans meet all standards, they will be approved and the public hearing will be scheduled (if required).

After a project has been submitted and passed Site Plan Review, the required public hearing is scheduled. Notice of the public hearing must be mailed to all residents, property owners, and businesses within 300 radial feet of the proposed Conditional Land Use, published in the Detroit Legal News, and posted on the property. The State of Michigan Zoning Enabling Act requires at least 15 days advance notice of such public hearings. Special Land Use public hearings are typically scheduled on Wednesday mornings starting at 9:00 a.m. and every half hour thereafter. The number of hearings on a given Wednesday varies but is usually between two and six. The fee is currently $1,000.00. Hearing Agenda:

  • The hearing officer announces the details of the hearing
  • A staff report is given by a BSEED building inspector
  • The development team provides a presentation on their proposal
  • A Planning & Development Department (P&DD) city planner gives a report and recommendation
  • The public is given the opportunity to ask questions and comment on the proposal

No decision is made at the hearing. Within 2-3 weeks, the hearing officer drafts a decision letter incorporating P&DD's recommendation, discussion from the hearing, and the specific approval criteria for Conditional Land Uses (Section 61-3-231). The decision letter will be mailed to the applicant, everyone who attended the hearing, and everyone who submitted a written comment regarding the proposed land use. Any decision letter may be appealed to the Board of Zoning Appeals (BZA) per Section 61-3-242 within 14 days of the decision date. If there is no appeal, the decision letter becomes effective. The applicant must then record it at the Wayne County Register of Deeds and file a building permit with BSEED to change the use and perform any construction work. After all required inspections are passed, a Certificate of Occupancy will be issued. Finally, if the proposed land use requires a Business License, such license can be applied for and issued. Only then may the new use be opened and operated.

A neighborhood petition is required to waive the restriction on certain uses being within 500 feet  of residentially zoned land.

The applicant is required to follow BSEED's written procedure, to use the supplied petition forms, to pay appropriate fees, and to successfully secure the signatures of at least 2/3 (67%) of all those persons eligible to sign such petition. Failure to obtain the required number of signatures means that the project may not proceed to site plan review or a public hearing. Neighborhood Petitions must be picked up from the Zoning Division in room 407.

Zoning Confirmation Letters

Types of zoning confirmation letter.

There are two types of Zoning Confirmation Letter:

  • A simple zoning analysis called Tier 2
  • A complex zoning analysis called Tier 3

Tier 2 is a simple zoning analysis that describes the uses allowed in the zone on a property.  A Tier 2 analysis does not evaluate complex questions about development allowances or review existing or proposed development plans.

Tier 2 applications include:

Bank letters

  • Includes a new or renewal of a DMV auto dismantler license

Tier 3 is a complex zoning analysis that includes a review of specific situations, specific questions, or documentation. These requests often supplement or are required before or during permit reviews.

Tier 3 applications include:

  • Archeological evaluations
  • Convenience store reviews

Documenting a nonconforming situation using standard evidence

  • Nonconforming upgrades option 2 reviews

Notice of use determination

  • Transfer of development rights (floor area and density transfer)

A tier 2 Zoning Confirmation Letter. Bank letters are used by financial institutions for due diligence purposes. They state the current zoning with a brief description and list relevant land use history of the property. 

Things to know about bank letters:

  • For any number of adjacent properties in the same ownership, you can request a single bank letter.
  • Properties separated by rights of way, even if they are in the same ownership must have different bank letters.
  • Properties under different ownership must have different bank letters.

Land use compatibility statements (LUCS)

A tier 2 Zoning Confirmation Letter. A Land Use Compatibility Statement (LUCS) is a portion of an application for a state-issued license. LUCS verifies that the use or activity requested in the state license is allowed by local zoning and land use regulations.

Many state or federal agencies need these statements, including:

  • Department of Environmental Quality (DEQ)
  • Division of State Lands (DSL)
  • Oregon Department of Agriculture (ODA)
  • Oregon Department of Education (ODE)
  • Oregon Department of Motor Vehicles (DMV) - for auto dismantling businesses
  • Oregon Department of Transportation (ODOT)
  • Oregon Health Authority (OHA)
  • US Department of Housing and Urban Development (HUD)

Request a land use compatibility statement

  • Get and complete the appropriate state form(s) for your project from the state agency.
  • Complete the Zoning Confirmation Request Form.
  • Submit your application request and include the state form(s).

Archeological evaluation

A tier 3 Zoning Confirmation Letter. The City of Portland includes some land along the Willamette and Columbia Rivers that may have been home to Native Americans prior to European contact and settlement. Pre-contact archeological resources have historic, cultural, and scientific value to the general public and the associated Native American Tribes.

In areas with a high probability of these archeological resources The Zoning Code requires analysis prior to ground-disturbing activities and development. 

This analysis is completed through a Tier 3 application process prior to approval of a permit for development.

  • Contact the BDS archeological resource specialist in Land Use Services for application requirements. Please call 503-823-7300 .
  • In addition to the information required for the analysis, you will need to submit the Zoning Confirmation Request Form.
  • Get the form and follow the instructions to submit your application in the section, Apply for a Zoning Confirmation Letter . 

Convenience store verification

A tier 3 Zoning Confirmation Letter. The Zoning Code has special requirements for convenience stores opening in a new location, or when an operator changes for an existing store. 

A convenience store is a retail grocery store that:

  • Is under 4,000 square feet in area;
  • Requires a package store liquor license; and
  • Is open more than 15 hours a day.

Portland Permitting & Development check those requirements on a site plan and documents required by Zoning Code chapter 33.219 through a Tier 3 Zoning Confirmation Review before completing the liquor license application review for the business.

A convenience store proposing to be located in a new or existing building is subject to the zoning regulations of Chapter 33.219. The regulations also apply when the operator of a convenience store changes.

  • Submit the application and supporting documents using the submittal instructions on the Planning Services page .

A tier 3 Zoning Confirmation Letter. Sometimes zoning regulations change and use or development is no longer allowed at a site. If the use or development was legally permitted or established prior to City Zoning, applicants can document the right to continue the use or development that is not allowed using standard evidence.

By documenting a nonconforming situation, the site owner is assured of whether or not the property really has vesting rights. More information:

Landscape monitoring reports review

Required landscape plantings are intended to enhance environmentally sensitive areas or to mitigate the loss of natural resource values as part of a proposed development.

To ensure the plantings become established, written proof is required on yearly intervals ranging between one and five years after installation of the plantings, depending on the size of the mitigation planting area.

Plants that die must be replaced in kind.

Monitoring of landscape areas is the ongoing responsibility of the property owner.

Specifications on mitigation and restoration plantings can be found in the zoning code on Landscaping and Screening, Mitigation and Restoration Plantings, Section 33.248.090 .

To ensure the required written proof of survival, you must provide us with a Landscape Monitoring Report Application before you can get a building permit.

When a Landscape Monitoring Report Review is required

  • When new development or alterations to existing development that exceeds the nonconforming development threshold is requested within the Greenway Overlay zone in South Waterfront Subdistrict and South Waterfront Greenway landscaping improvements are required.
  • When new development or alterations to existing development within the River Environmental Overlay zone requires mitigation plantings.
  • When a correction to a violation within the Environmental or River Environmental overlay zones requires mitigation or restoration plantings.
  • When submitting monitoring reports for review that were required by a condition of land use approval to document the survival of mitigation plantings. These conditions are typically found in Environmental, Greenway and River Review land use decisions.

The fee is based on the number of monitoring reports required.

Nonconforming upgrades option 2 review

A tier 3 Zoning Confirmation Letter. In permit reviews that prompt zoning upgrades, there is an option to defer those upgrades to a later time. In exchange, all zoning upgrades that apply to the property must be completed later.

With this option, the property owner signs a covenant with the City to complete the work later. The upgraded work does not need to be shown in the individual permit(s). These reviews are assigned to the planner reviewing the building permit(s).

A tier 3 Zoning Confirmation Letter. The Zoning Code classifies land uses and activities into categories of use.

"Use" is based on common functional, product, or physical characteristics that include:

  • the type and amount of activity
  • the type of customers or residents
  • how goods and services are sold or delivered
  • site factors

It is beneficial to know the use category of a proposed business or project before you apply for a permit so you can understand the Zoning regulations that apply.

Use determinations prior to permit(s) or land use reviews can be requested through a Tier 3 application.  In this review, a planner will evaluate information that you submit describing the nature of your business or activity and determine the use.

You will need to provide information to determine a use category. This includes:

  • A description of the activity(ies) in relationship to the characteristics of each use category
  • The relative amount of site or floor space and equipment devoted to the activity
  • Relative amounts of sales from each activity
  • The customer type for each activity
  • The relative number of employees in each activity
  • Hours of operation
  • Building and site arrangement
  • Vehicles used with the activity
  • The relative number of vehicle trips generated by the activity
  • How the use is advertised
  • Whether the activity would be likely to be found independent of the other activities on the site

  • Provide the information listed to determine a use category.

Transfer of development rights (floor area and density transfer)

A tier 3 Zoning Confirmation Letter. The Portland Zoning Code allows property owners to transfer a part of the development potential from their property to other properties in some situations. This includes residential density allowances or building Floor Area Ratio (FAR) allowances.

These are available in:

  • commercial/mixed-use zones
  • employment and industrial zones
  • multi-dwelling zones

Who can request a transfer?

Property owners can complete density and FAR transfers, but you may want to get help from private legal counsel.

The Transfer Covenant template will need to be reviewed and approved by Land Use Services and in some cases, the City Attorney’s Office. After approval by the City, the property owner(s) record the covenant form against the property titles of the sites sending and receiving the development rights.

  • Complete the FAR/Density Transfer Request Application Form. 
  • Submit your completed form. Use the  instructions on the Planning Services page  to apply.
  • Complete the Transfer Covenant template. When we receive your application, a city planner will contact you and send you a Transfer Covenant template that you'll fill out with your project information. The template describes the property sending the development potential and the property receiving it. It also notes how much development potential will result at each property after the transfer.
  • The Transfer Covenant template will be reviewed by Land Use Services and in some cases, the City Attorney’s Office.
  • Once approved, the property owner(s) record the covenant form against the property titles of the properties sending and receiving the development rights.
