In Seattle, the use of land (i.e. what you can do on private property) is regulated by the Land Use Code (Seattle Municipal Code (SMC) Title 23). The Land Use Code protects and promotes public health, safety, and general welfare. It does this through a set of regulations and procedures that implement the City's Comprehensive Plan . The Land Use Code establishes noticing procedures to promote informed public awareness of land use permit applications. The Land Use Code also establishes procedures for the coordination of review processes. The Land Use Code classifies land within the City into various zones and overlay districts to regulate uses and structures. The zoning regulations are designed to:
The Code seeks to guide the efficient use of land with limited impact to the natural environment. The Code also directs development toward lots with adequate services and amenities that support the use. We issue public notice to increase awareness of land use and development proposals, master use permit applications and decision, and public meetings and hearings. The Zoning Division conducts plan reviews and public hearings for Conditional Land Uses per the City of Detroit Zoning Ordinance. Conditional Land Uses may be subject to developmental conditions resultant of the plan review process. The Zoning Division also conducts historical research for the purpose of zoning verification.

Zoning / special land use faq.
Site Plan Review (SPR) is mandated by the City of Detroit Zoning Ordinance Chapter 61 in several specific instances including all Conditional Land Uses (Section 61-3-113). Depending on the zoning district, either the Planning and Development Department (P&DD) or City Council (through the City Planning Commission) has the power to review and approve site plans. BSEED is authorized to participate in the review process. To apply for SPR, three sets of properly dimensioned and drawn-to-scale Site, Floor, and Elevation Plans must be submitted along with the appropriate fee ($100.00 for Conditional Uses and $160.00 for all other uses) to the Plan Review Division, Room 409. Staff will review the plans for compliance with zoning, design, and operational requirements, typically within 10 days of receipt of a complete submission package. The applicant will be informed of necessary modifications, alterations, and/or improvements or, if the plans meet all standards, they will be approved and the public hearing will be scheduled (if required).
After a project has been submitted and passed Site Plan Review, the required public hearing is scheduled. Notice of the public hearing must be mailed to all residents, property owners, and businesses within 300 radial feet of the proposed Conditional Land Use, published in the Detroit Legal News, and posted on the property. The State of Michigan Zoning Enabling Act requires at least 15 days advance notice of such public hearings. Special Land Use public hearings are typically scheduled on Wednesday mornings starting at 9:00 a.m. and every half hour thereafter. The number of hearings on a given Wednesday varies but is usually between two and six. The fee is currently $1,000.00. Hearing Agenda:
No decision is made at the hearing. Within 2-3 weeks, the hearing officer drafts a decision letter incorporating P&DD's recommendation, discussion from the hearing, and the specific approval criteria for Conditional Land Uses (Section 61-3-231). The decision letter will be mailed to the applicant, everyone who attended the hearing, and everyone who submitted a written comment regarding the proposed land use. Any decision letter may be appealed to the Board of Zoning Appeals (BZA) per Section 61-3-242 within 14 days of the decision date. If there is no appeal, the decision letter becomes effective. The applicant must then record it at the Wayne County Register of Deeds and file a building permit with BSEED to change the use and perform any construction work. After all required inspections are passed, a Certificate of Occupancy will be issued. Finally, if the proposed land use requires a Business License, such license can be applied for and issued. Only then may the new use be opened and operated.
A neighborhood petition is required to waive the restriction on certain uses being within 500 feet of residentially zoned land.
The applicant is required to follow BSEED's written procedure, to use the supplied petition forms, to pay appropriate fees, and to successfully secure the signatures of at least 2/3 (67%) of all those persons eligible to sign such petition. Failure to obtain the required number of signatures means that the project may not proceed to site plan review or a public hearing. Types of zoning confirmation letter.
There are two types of Zoning Confirmation Letter:
Tier 2 is a simple zoning analysis that describes the uses allowed in the zone on a property. A Tier 2 analysis does not evaluate complex questions about development allowances or review existing or proposed development plans.
Tier 2 applications include:
Tier 3 is a complex zoning analysis that includes a review of specific situations, specific questions, or documentation. These requests often supplement or are required before or during permit reviews.

A tier 2 Zoning Confirmation Letter. Bank letters are used by financial institutions for due diligence purposes. They state the current zoning with a brief description and list relevant land use history of the property.

Submit a completed Zoning Confirmation Request Form. Get the form and follow the instructions in the section, Apply for a Zoning Confirmation Letter .
A tier 2 Zoning Confirmation Letter. A Land Use Compatibility Statement (LUCS) is a portion of an application for a state-issued license. LUCS verifies that the use or activity requested in the state license is allowed by local zoning and land use regulations.

A tier 3 Zoning Confirmation Letter. The City of Portland includes some land along the Willamette and Columbia Rivers that may have been home to Native Americans prior to European contact and settlement. Pre-contact archeological resources have historic, cultural, and scientific value to the general public and the associated Native American Tribes.
In areas with a high probability of these archeological resources The Zoning Code requires analysis prior to ground-disturbing activities and development.
This analysis is completed through a Tier 3 application process prior to approval of a permit for development.
A tier 3 Zoning Confirmation Letter. The Zoning Code has special requirements for convenience stores opening in a new location, or when an operator changes for an existing store.

A convenience store proposing to be located in a new or existing building is subject to the zoning regulations of Chapter 33.219. The regulations also apply when the operator of a convenience store changes.
A tier 3 Zoning Confirmation Letter. Sometimes zoning regulations change and use or development is no longer allowed at a site. If the use or development was legally permitted or established prior to City Zoning, applicants can document the right to continue the use or development that is not allowed using standard evidence.
By documenting a nonconforming situation, the site owner is assured of whether or not the property really has vesting rights. More information:
Required landscape plantings are intended to enhance environmentally sensitive areas or to mitigate the loss of natural resource values as part of a proposed development.
To ensure the plantings become established, written proof is required on yearly intervals ranging between one and five years after installation of the plantings, depending on the size of the mitigation planting area.

A tier 3 Zoning Confirmation Letter. In permit reviews that prompt zoning upgrades, there is an option to defer those upgrades to a later time. In exchange, all zoning upgrades that apply to the property must be completed later.
With this option, the property owner signs a covenant with the City to complete the work later. The upgraded work does not need to be shown in the individual permit(s). These reviews are assigned to the planner reviewing the building permit(s).
A tier 3 Zoning Confirmation Letter. The Zoning Code classifies land uses and activities into categories of use.

It is beneficial to know the use category of a proposed business or project before you apply for a permit so you can understand the Zoning regulations that apply.
Use determinations prior to permit(s) or land use reviews can be requested through a Tier 3 application. In this review, a planner will evaluate information that you submit describing the nature of your business or activity and determine the use.

A tier 3 Zoning Confirmation Letter. The Portland Zoning Code allows property owners to transfer a part of the development potential from their property to other properties in some situations. This includes residential density allowances or building Floor Area Ratio (FAR) allowances.

The Transfer Covenant template will need to be reviewed and approved by Land Use Services and in some cases, the City Attorney’s Office. After approval by the City, the property owner(s) record the covenant form against the property titles of the sites sending and receiving the development rights.
