In general, your company`s human resources or finance department is responsible for issuing your Form 16. This allows you to send emails to your human or financial resources department. Once logged into Cleartds.com, go to the TDS Return Dashboard under Deduction and click “Work on this return”. You can see “Import Traces” at the bottom of the page. Click on it to apply for Form 16A. You can calculate your net income tax payable using this Form 16 in Excel format. You will need to enter your salary and benefit details, and your net tax will be calculated automatically. Anyone responsible for paying a salary must deduct TDS before payment. The Income Tax Act states that any person who deducts TDS from a payment must provide a certificate with the TDS details deducted and deposited. In particular, an employer is required to provide a certificate in the form of Form 16.

After successfully filing the TDS tax return for payments other than salary – Form 26Q, you will need to download Form 16A. It can be downloaded from TRACES and is considered valid TDS certificates according to CBDT Circular 04/2013 of 17 April 2013. Form 16A is generated only for a valid PAN. If there is an invalid PAN or if the PAN is not reported in the TDS statement, Form 16A is not generated. Cleartds helps you apply for and download Form-16A. Frequently Asked Questions (FAQ) on Form 16/16A

What is Form 16 / 16A?

It is the certificate of deduction of tax at source by any person in accordance with Chapter XVII-B of IT Act.  Form 16 is issued on deduction of tax by the employer on behalf of the employee under section 192 of IT Act, 1961.  Form 16A is issued if the deduction of tax is under any other provision of Chapter XVII-B of IT Act.  These certificates provide details of TDS / TCS for various transactions between deductor and deductee. It is mandatory to issue these certificates to Tax Payers u/s 203 of IT Act, 1961.

Is there any format for these certificates?

Form 16 / 16A are issued as per the provisions of Rule 31(1).

How are these forms generated?

These forms shall be generated by TDS CPC on processing the quarterly TDS / TCS statements filed by deductor. Deductor will have to raise a request for the same on TRACES. Deductor shall have the option to digitally sign the certificates.

What is the due date for the issue of these certificates?

What should I do if I am not getting Form 16 from TRACES?

Ensure that you have filed Form 24Q for Quarter 4 with Annexure II. It is mandatory to file Annexure II giving actual particulars for the entire financial year, as Form 16 is generated on the basis of information provided in Annexure-II.

How are the particulars of those employees who are employed with more than one employer in a financial year to be shown in Form 16?

The employee should declare previous salary and TDS details, if any, with the current employer and the same should be considered by the current employer while deducting TDS on salary and issuing Form 16.

What can I do if I am unable to get the TDS certificate (Form 16 / 16A)?

It is the duty of every person deducting tax to issue a TDS certificate. In spite of your request, if you are denied the certificate then there is a chance that the tax deducted has not been deposited by the deductor to the government account. Please inform the department (PRO or TDS section) which will then do the needful.

I have not received TDS certificate from my employer. Can I claim TDS deducted from my salary?

Yes. The claim can be made in your return. Department, however, will raise a demand which will not be enforced on you but on your employer.

If a deductee comes back stating that the original TDS certificate is lost, can a duplicate certificate be issued?

Yes. Deductor will have to issue the duplicate certificate.

Even if no taxes have been deducted from salary, is there any need for my employer to issue Form 16 to me?

Form 16 is a certificate of TDS and in your case it will not apply. However your employer must issue a salary statement.

If I am receiving my pension through a bank who will issue Form 16 or pension statement to me – the bank or my former employer?

The bank will issue Form 16.

Can deductor download Form 16 without being registered on TRACES?

No, only registered user (deductor) on TRACES can download Form 16 / 16A.

While submitting request to download Form 16 / 16A, deductor has entered details correctly in Part 1 and Part 2 in validation details screen, yet it shows error as ‘Invalid Details’ in Part 1 and Part 2. What should deductor do?

Details to be filled in validation screen should be exactly the same as reported in the TDS statement. If you have filed any correction statement, Token Number and other details should be as per the latest correction statement.

I am unable to download Form 16 / 16A as the number of PANs for which Form 16 / 16A were submitted was higher, however the PDFs generated were less. What should I do?

Check the status of the PANs for which Form 16 / 16A has not been generated. These PANs might be with inactive status or not present in the TDS statement filed.

What is the password for opening Form 16 / 16A text file?

The password for opening Form 16 / 16A will be your TAN in capital letters, i.e., AAAA11111A.

Registered user on TRACES has updated the communication and address details on TRACES. However while downloading Form 16A, it shows a different address. How can deductor edit address details in Form 16A?

Details updated in ‘Profile’ section of your TRACES account will be saved only in TRACES and will not be updated in TAN database. To change details in TAN database, submit TAN change request form (Form 49B) at www.tin-nsdl.com .

Can I make any changes in the certificate generated by TDS CPC?

The certificates shall be generated in PDF format, therefore they are not editable. Deductor is thereby not permitted to make changes to these certificates. If any error is identified in the certificate, deductor will have to file a correction statement for the same.

Can Form 16 (Part A) / Form 16A be issued manually?

No. Only the Form 16 (Part A) / Form 16A downloaded from TRACES are considered as valid TDS certificates, as per CBDT circular 04/2013 dated 17th April, 2013.

What should I do in case company name is updated incorrectly in Form 16 (Part A) / Form 16A?

You need to check the respective quarterly statement and file a correction for the same. After filling correction, download Form 16 (Part A) / Form 16A.

How can I edit or add detail of authorized person in Form 16 / Form 16A?

Details of authorized person can be updated in ‘Profile’ section of deductor’s account in TRACES.

Form 16 is only generated for the employees filled in ANNEXURE 1 (deduction details) if you want to generate the form 16 you have to record those dedcutors in the annexure I show their salary FIGURE and show TDS Deducted AS ZERO

Forms 16 and 16A are essential for taxpayers since they are used to calculate the amount of tax owed. They are also required to file income tax returns. Taxpayers frequently mix up the two documents due to their nearly identical purpose.

In this article, we will discuss  Form 16 , and Form 16A, and the differences between them.

What is Form 16?

Form 16 is your salary TDS certificate.

  • If your income from salary for the financial year is more than the basic exemption limit of Rs 2,50,000 your employer is required, by the Income Tax Act, to deduct TDS from your salary and deposit it with the government.
  • If you have also disclosed your income from other heads to your employer, they will consider your total income for TDS deduction.
  • If your income is below the basic exemption limit, your employer will not deduct any TDS and may not issue this form to you.
  • If you have worked with more than one employer during the year, you will have more than one Form 16.
  • Form 16 is one of the essential documents which is required to file your ITR
  • Only the TDS details of Form 16 are available in Form 26AS.

What are the Components of Form 16?

This  Form 16 is a certificate, where the employer certifies details regarding the salary you have earned during the year and how much TDS has been deducted. It has two parts – Part A and Part B.

  • Part A has information about the employer & employee, like name & address, PAN and TAN details, the period of employment, and details of TDS deducted & deposited with the government.
  • Part B includes details of salary paid, other incomes, deductions allowed, tax payable, etc.

Form 16 is a certificate issued to salaried individuals by their employer when he deducts tax from the employee's salary. In simple words, it is an acknowledgement that states your deducted tax has been deposited with the income tax department. It must be issued by 15th June of the year for which it is being issued. For example, for the F.Y. 2023-24, the due date for the issue of Form 16 shall be 15th June 2024. 

What is Form 16A?

Form 16A is also a TDS Certificate. While Form 16 is for only salary income, Form 16A is applicable for TDS on ‘Income Other than Salary’.

For example, a Form 16A shall be issued to you – when a bank deducts TDS on your interest income from fixed deposits, for TDS deducted on insurance commission, for TDS deducted on your rent receipts. In fact, when TDS is deducted from any other income you receive, that is liable for such deduction.

This certificate also has details of the name and address of the deductor/deductee, PAN/TAN details, and challan details of the TDS deposited. It also has details of income you have earned and the TDS deducted and deposited on such income. All details that are there in Form 16A are available on Form 26AS. This can be used to file your return.

However, the same is not the case with Form 16. Details of Form 16 that are available in Form 26AS are only TDS deducted by the employer. Both forms are important and are required to help you  file your return smoothly. You can also verify the income details and how much TDS has been deducted and at what rates.

What are the Components of Form 16A?

Form 16A includes details like:

  • Employer’s name, PAN and TAN
  • Employee’s name, PAN and TAN
  • Payment details
  • TDS payment number
  • Date of deposit and deposited tax amount

These details are also available in Form 26AS.

An employer deducting tax or TDS on the salary paid to an employee issues Form 16 to the employee.

The employer issues Form 16 on an annual basis, for one financial year.

A Form 16A is issued quarterly. The due date is the 15th of the month following the due date for the quarterly TDS return.

You can use the data of income and TDS in Form 16 and Form 16A to file your income tax return and calculate and pay your tax.

You can log in to your income tax portal and check your Form 26AS if the amount shown in Form 16A is being reflected. Also, Form 16A should be generated from the TRACES portal, which will have the watermark of the TRACES logo.

It is essential to have Form 16 issued by your employer since it contains details of your salary, Deduction and exemption. 

However Details of Form 16 part A and Form 16A details on a consolidated basis will be available in your income tax portal in Form 26AS. I.e Instead of referring to each and every Form 16A to claim the TDS, You can utilise Form 26AS, which will contain consolidated data of all the TDS done in the financial year.

What is Form 16 & 26AS?

According to the Income Tax Act for form 16, every employer is obligated to deduct Tax (or TDS – Tax deducted at source) when paying salaries, which is calculated based on the income tax slab rates in effect for that fiscal year. Companies often compute the employee’s tax liability based on expected earnings and investment declarations made by the employee at the start or throughout the year.

The TDS deducted by the organisation or employer is submitted with the Income Tax department, and Form 16 serves as documentation of this. Employers must provide Form 16 to their workers on or before May 31st of the fiscal year following the fiscal year in which the income was paid and tax deducted.

Form 16 Components

Form 16 is one of the most significant income tax forms for salaried persons. It comprises all of the information connected to the employee’s salary as well as the tax that has been deducted from the salary by the deductor.

Form 16 is divided into two halves, which are as follows:

Part A summarises the tax collected by the organisation or employer from salary revenue on behalf of the employee and placed in the government’s account. It is a certified certification by the employer that the TDS has been taken from the employee’s wage and submitted with the income tax department.

It includes the following information: 

  • Personal information about both the employer and the employee. Particulars such as the individual’s and employer’s names, addresses, PAN numbers, and TAN numbers. (TAN refers to the number allocated to an account responsible for the deduction and collection of tax). These information assist the IT Department in tracking the movement of money from employee and employer accounts. (It should be noted that an organisation cannot deduct TDS if it does not have the TAN. As a result, in this case, they will not give the Form 16).
  • The Academic Year (AY) – As the name implies, this relates to the year in which the income is assessed, or the year in which the taxpayer must work on the tax return processes. For example, the Assessment Year for income received between 1 April 2015 and 31 March 2016 will be 2016-17.
  • The time period for which the individual was employed with the employer in the relevant Financial Year 
  • A summary of the salary paid 
  • The date of tax deduction from the salary 
  • The date of tax deposit in the government account 

This section is created and downloaded using the Income Tax Department’s Traces site. It also includes information such as the bank’s BSR code, challan numbers, and so on for future reference. The deductor must digitally or physically sign all pages of Part A.

Form 16 Part B 

Part B is a consolidated statement that includes information on the employee’s pay, any other income declared to his or her organisation, and the amount of tax paid and tax owed, if any. It represents the information in a thorough and orderly manner, stating the employee’s income as well as the appropriate exemptions and deductions, in the approved format. Even in Part B, employee information such as name and PAN are mentioned.

It includes the following details:

Total Salary Received: The salary structure is further subdivided into components such as House Rent Allowance, Leave Travel Allowance, Leave Encashment, Gratuity, and others.

Exemptions Allowed: As per Section (10) of the Income Tax Act of 1961, allowances provided to workers for conveyance, housing rent (HRA), children’s education and hostel expenses, medical expenses, and so on are also listed in the form.

Gross Income: This is the total of the employee’s pay income and any additional income disclosed by the employee, such as income from a house/property, etc. During the investment evidence submission step, the employee must submit information about additional income with the employer.

Salary Deductions: Section 80 C / 80 CCC / 80 CCD comprises payments paid to instruments or schemes such as Public Provident Fund, Life Insurance plans, tax saving mutual funds, pension, Sukanya Samriddhi, and so on. The highest amount allowed is Rs. 1,50,000.

Other parts allow deductions such as 80D (premium paid towards health insurance or Mediclaim), 80E (interest payment on education loan), 80G (donations), disability deductions, and other appropriate sections. The employee must submit the specifics for all of these deductions to the employer, together with the relevant supporting paperwork.

Net Taxable Salary: To calculate taxable income, total deductions are aggregated under “Chapter IV-A” and subtracted from gross income. This amount is used to determine your tax due.

  • Any education cess and surcharges
  • Section 87 rebate, if appropriate
  • Any relief available under Section 89
  • Total amount of income tax owed
  • Tax deducted and balance tax due or rebate applicable

Types of Form 16

Other than Form 16, you will receive two forms of Form 16 if you earn money other than salary:

Form 16A: Form 16 is a TDS certificate that shows the TDS deducted by your employer from your wage income. Form 16A, on the other hand, is a TDS certificate that applies to TDS on income other than wages. For example, if your bank deducts TDS on your interest income from Fixed Deposits, TDS on rent receipts, TDS on insurance commissions, or any other income liable for such deduction, you would obtain a Form 16A.

Form 16B: Form 16B is a TDS certificate for TDS deducted on the sale of property and shows that the Buyer’s TDS money has been deposited with the Income Tax Department. When purchasing immovable property, the buyer must subtract 1% TDS on Property from the amount he must pay the seller. The buyer is then obliged to file the TDS with the Income Tax Department and give Form 16B to the property’s seller. Form 16B provides documentation that the TDS deducted on the property’s sale been submitted with the government.

What are the Form 16 Eligibility Criteria?

According to the laws established by the Indian Government’s Finance Ministry, any salaried individual who falls within the taxable category is entitled for Form 16.

If an employee does not fit under the tax categories established, Tax Deducted at Source (TDS) is not required. As a result, in these instances, the firm is not required to provide the Form 16 to the employee. However, as a good work practise, many organisations, even in these instances, now offer this certificate to the employee because it contains a consolidated picture of the individual’s earnings and has various added purposes.

Form 16 Download Instructions

Only your employer may download and issue Form 16. Individuals are not permitted to download their Form 16.

  • It is a prevalent misperception that an individual may obtain Form 16 using their PAN number from the TRACES website. All salaried employees are entitled to receive a Form 16 from their employers.
  • If your employer deducts TDS from your salary, he must submit Form 16, which is a TDS certificate indicating that TDS has been deposited with the government.
  • Additionally, the employer should provide Form 16 before the fiscal year’s due date of May 31.

What is the Importance of Form 16 for Salaried People?

Form 16 is critical for a salaried individual in terms of income tax. The information on this Form is essential for the filing of Income Tax Returns.

With this certificate, taxpayers in India may simply complete their own income tax returns without the assistance of Chartered Accountants or financial consultants. This is more relevant for individuals whose main source of income is the wage they get from their employer.

Form 16 can be used to compare amounts with Form 26AS to ensure that accurate taxes are put in the government account.

It is also regarded as an important document for tax compliance in addition to being an evidence of TDS. It is the sole document that an employee must provide to establish that he or she has paid taxes, and it may be used as proof during any income tax audit. Banks, other lenders, and financial organisations regard it as genuine evidence of income as well. Many financial institutions request this document as part of the loan application verification procedure.

As part of the onboarding process, many organisations demand the prior employer’s income tax Form 16 (from the same fiscal year) to be supplied. This assists them in ensuring that they compute the tax payable appropriately, as income tax slabs alter depending on an individual’s total earnings in that year.

Also, if one is preparing to travel overseas, many visa checklists, such as the one for the Schengen visa, need Form 16 to be provided as one of the papers.

Multiple Employers in a Fiscal Year

People who have changed employment and so worked with many employers in a given fiscal year will obtain unique Form 16s from each company.

What Should a Receiver Check in Form 16 Look Like?

When an employee gets the Form 16, it is his or her obligation to ensure that all of the information on the form is correct. Aside from checking personal information and the amount of income and TDS deducted, the most significant thing to validate in Form 16 is the PAN number . If it is mentioned incorrectly, contact the organization’s HR/Payroll/Finance Department immediately to get it fixed. The employee’s employer will provide a corrected and updated Form 16. Aside from that, the employer would need to make a correction from their end by filing a corrected tax return in order to credit the TDS.

Employer’s Responsibilities Regarding Form 16

The employer or deductor must ensure that all of the information on Form 16 is correct, including salary, deductions, PAN , TAN , and so on, and that each page is signed by a competent and accountable corporate representative. Furthermore, the certificate should be provided to the employee on or before May 31st, so that individuals may submit their tax returns on time.

Previous Years’ Form 16

If a person misplaces their or her previous TDS Form 16, they can contact the involved employer, who would provide them with a duplicate copy of the same.

Is Form 16 and Form 16A the same thing?

While many individuals mistakenly believe that both of these versions are the same and use the names interchangeably, they are not. In layman’s terms, Form 16A is the TDS Certificate for non-salary income.

People who provide services to an organisation as consultants rather than employees and earn contractual/professional and other fees for their services are entitled to get Form 16A. There are several more situations where TDS may be relevant, such as the tax on interest generated on Fixed Deposits, for example. In this case, the bank is the entity/organization that deducts the tax at the source. As a result, for each fiscal year, they must provide the client with a TDS certificate known as Form 16A.

Form 16A is also provided for insurance commission tax deductions. This certificate contains personal information about the deductor and deductee, such as name, address, PAN/TAN data, and TDS deducted and deposited. Also given is the revenue from which TDS is deducted.

Is There a Connection? Between Forms 16 and 26AS

Form 26AS will aggregate any tax deducted from your salary and/or non-salary income and deposit it with the appropriate authorities. This form will also include information about any tax refunds received throughout the fiscal year. As a result, tax deductions reported on Form 16 / Form 16 A can be cross-checked and validated with Form 26AS. Ideally, the TDS amounts shown on Form 26AS and Form 16/16A should always be the same. If there are any anomalies, the Income Tax Department solely analyses the TDS values from Form 26AS.

Form 16 and Tax Return

Form 16 is one of the most important documents to have on hand before or during the filing of an income tax return on or before July 31st of each year.

It is a beginner error to presume that if there is no balance tax payable listed in Form 16, the individual can simply copy the Form 16 information into the tax return form. This is not always the case. The tax collected at source by the organisation or employer is based on the tax slabs applicable to total earnings as known and stated by the employer.

If you earned any income during the year that you did not share with your employer (such as bank interest), it will not be reported on Form 16, but it should be included in your tax return. Furthermore, the TDS deducted by another deductor, such as a bank, may not be adequate since they deduct tax on a fixed percentage, such as 10%, but a higher slab rate may be applicable when all income sources are aggregated and therefore there is a tax required in your return. As a result, in addition to the deductions stated on Forms 16 and/or 16A, there may be a tax due when submitting the return.

Is the absence of Form 16 synonymous with the absence of a tax return?

The employer is responsible for deducting tax from salary and submitting a TDS certificate, and failure to do so would result in a pecuniary penalty of Rs. 100 per day of default, according to Section 272A(2)(g) of the I-T Act.

If, despite several requests, an organisation or employer refuses to issue the certificate, it is possible that the tax deducted has not been paid with the appropriate government authorities. Employees are encouraged to notify the relevant Assessing Officer, who will then take the appropriate corrective measures and commence the penalty procedures against the employer.

However, it is the individual’s responsibility to pay income taxes and file returns. As a result, if a person does not get Form 16 from his or her employer for any reason, he or she is not excluded from submitting tax returns on those grounds. Alternate papers can be utilised to work on your Income Tax Return filing, such as Form 26AS, which can be accessed from the Income Tax / Bank website, TDS Certificates from the bank, tax saving investment evidence, rent receipts, and your wage slips.

Keeping Form 16

Although Form 16 is not needed to be included as a supporting document when filing income tax returns, it must be kept for at least six years after the end of the relevant assessment year. As a result, be certain that the Form 16 is not thrown out in the midst of the holiday cleaning frenzy.

  • How can I obtain Form 16? Is it possible for me to download my Form 16 myself?

Answer : Only your employer may download and issue Form 16. Form 16 cannot be downloaded by a person on their own. Employers are required to provide Form 16 to all salaried employees.

  • Is it possible to produce Form 16 without a PAN?

Answer : Form 16A can only be generated with a valid PAN. Form 16A will not be created if a PAN is not reported in the TDS statement or if the PAN is invalid.

  • Who issues Form 16 to retirees?

Answer : Form 16 is issued by the bank through which a retiree receives their pension. Their prior employers are not obligated to give their Form.

Through Sept. 30, 2024, there is no fee to file Form I-485, Application to Register Permanent Residence or Adjust Status , on the basis of classification as an Afghan special immigrant, or for any associated biometric services or to file an associated Form I-601.

Through Sept. 30, 2024, there is no fee to file Form I-601 individually with an approved Form I-130, Petition for Alien Relative , filed with USCIS in the United States for an Afghan national (beneficiary) who has a visa immediately available.

You can pay the fee with a money order, personal check, cashier’s check or  pay by credit card or debit card using Form G-1450, Authorization for Credit Card Transactions . If you pay by check, you must make your check payable to the U.S. Department of Homeland Security.

If you submit any documents (copies or original documents, if requested) in a foreign language, you must include a full English translation along with a certification from the translator verifying that the translation is complete and accurate, and that they are competent to translate from the foreign language into English.

  • Evidence to support your request for a vaccination exemption (if applicable).
  • Evidence to support a waiver of inadmissibility due to physical or mental disorder and associated harmful behavior (if applicable).
  • Evidence to support a waiver of criminal grounds of inadmissibility found in INA section 212(a)(2) (if applicable)
  • Evidence to support waiver for immigration fraud or misrepresentation (if applicable).
  • Evidence to support a waiver for inadmissibility because of your membership in a totalitarian party (if applicable).
  • Evidence to support a waiver for inadmissibility due to alien smuggling (if applicable).
  • Evidence to support a waiver of inadmissibility due to being the subject of a civil penalty under INA section 212(a)(6)(F) (if applicable).
  • Evidence to support a waiver of the 3-or 10-year unlawful presence bar under INA section 212(a)(9)(B)(v) (if applicable).
  • If you are a TPS applicant, evidence that a waiver is warranted. 
  • Evidence that you warrant a waiver of inadmissibility based on factors that would be considered if you were seeking consent to reapply if you are seeking adjustment of status under NACARA section 202 or HRIFA section 902, and inadmissible under INA section 212(a)(9)(A) or (C). 
  • Evidence that shows connection between the battery or extreme cruelty that is the basis for the VAWA claim and the self-petitioner’s removal, departure from the United States, reentry or re-entries into the United States, or attempted reentry into the United States if you are an approved VAWA self-petitioner or child of an approved VAWA self-petitioner and inadmissible under INA section 212(a)(9)(C)(i).   
  • Evidence to support waiver if you are an applicant for adjustment of status as a Special Immigrant Juvenile (if applicable).

  • Any other noncitizen for whom  a determination of their likelihood of becoming a public charge under section 212(a)(4) is not required at the time of their application for admission or adjustment of status.

More than a million borrowers who were defrauded by for-profit schools have had billions of dollars in federal student loans eliminated through a government aid program. But people with private loans have generally been excluded from any relief — until recently.

Navient, a large owner of private student loan debt, has created, but not publicized, a program that allows borrowers to apply to have their loans forgiven. Some who succeeded have jubilantly shared their stories in chat groups and other forums.

“I cried, a lot,” said Danielle Maynard, who recently received notice from Navient that nearly $40,000 in private loans she owed for her studies at the New England Institute of Art in Brookline, Mass., would be wiped out.

Navient, based in Wilmington, Del., has not publicized the discharge program that helped Ms. Maynard. Other borrowers have complained on social media about difficulties getting an application form. When asked about the program and the criticisms, a company spokesman said, “Borrowers may contact us at any time, and our advocates can assist.”

So a nonprofit group of lawyers has stepped in to ease the process: On Thursday, the Project on Predatory Student Lending , an advocacy group in Boston, published Navient’s application form and an instruction guide for borrowers with private loans who are seeking relief on the grounds that their school lied to them.

“We want to level the playing field and let people know, instead of having it be this closely held secret,” said Eileen Connor, the group’s director.

Senator Elizabeth Warren, Democrat of Massachusetts, and eight Senate colleagues sent Navient a letter last month with a lengthy list of questions about the program. Navient responded, but did not directly address many of the senators’ questions.

Navient’s new program — which it calls a “school misconduct discharge” — is something of a private parallel to a federal program known as “ borrower defense to repayment ,” which allows those who were seriously misled by their schools to have their federal student loans eliminated. Under President Biden, the Education Department revived the relief program and used it to cancel nearly $30 billion in debt owed by 1.6 million borrowers.

The Project on Student Predatory Lending backed a class-action lawsuit against the government that led to a 2022 settlement under which nearly 200,000 borrowers had their federal student debts eliminated. Ms. Maynard, who is 34, shed $38,000 in federal loans through that deal.

But she, like many borrowers, remained mired in private student loans. Ms. Maynard paid $700 a month to Navient for more than a decade for her private loans.

For nearly a decade, in the early 2000s, Navient — then known as Sallie Mae — struck deals with for-profit schools to issue private loans to their students. Lawsuits from state attorneys general later accused Navient of making those loans knowing that most would never be repaid . Many schools indemnified Navient for the private loans, agreeing to defray the company’s loss if the loans defaulted.

In 2022, Navient settled with 40 state attorneys general and canceled $1.7 billion in debt on those private loans — but only for borrowers who had already defaulted. Because those debts were unlikely to ever be repaid, the deal cost Navient only $50 million, the company said in regulatory filings. Borrowers who had kept paying their bills, like Ms. Maynard, remained stuck.

But a pressure campaign from lawmakers, federal regulators and lawyers representing borrowers prompted the company to create the “school misconduct discharge.”

Navient began sending a 12-page application form this year to some borrowers who complained about their private loans. The document lists dozens of types of impropriety by schools — such as inflating job placement rates and graduates’ earnings, or misrepresenting their educational programs — and asks borrowers to choose which apply to their experience. Applicants are required to submit documentation for their claims.

After Ms. Maynard’s federal loans were eliminated last year, she stopped making payments on her private loans and called Navient, seeking relief options.

A few months ago, Navient sent her its misconduct discharge form. Weeks later, she received the notice that her application had been approved.

The senators’ letter to Navient called its private loan discharge process “burdensome and confusing.” It also asserted a legal basis for borrowers’ claims that their loans should be canceled: the so-called holder-in-due-course rule, a 1975 regulation by the Federal Trade Commission that lets those who use certain types of loans contest the debt if the goods they bought were fraudulent.

The response that Navient sent the senators acknowledged the rule as a ground for claims. “We are committed to canceling all loans that meet the Holder Rule criteria,” Navient’s chief executive, David Yowan, wrote in the letter, which was reviewed by The New York Times.

The letter said Navient had discharged “some” loans for borrowers who raised claims under the rule, and had “recently introduced an enhanced process for borrowers to seek discharge,” which it described as “still in its early stages.”

Mr. Yowan told investors on a conference call in January that Navient had put $35 million in reserve for losses on school-misconduct claims. He cited “new regulatory expectations” as the reason. Navient has not disclosed how much of its $16.6 billion private student loan portfolio consists of loans that could be eligible for the debt cancellation program.

Senator Warren said in a written statement this week, “Navient has admitted responsibility for canceling their predatory loans but set up a process for cancellation that’s impossibly confusing for borrowers.”

Some trying to navigate the process have already failed.

Thomas Jean-Mastej had his federal loans for studies at American InterContinental University — a school cited by the Federal Trade Commission for deceptive recruiting tactics — canceled through the borrower defense program. In March, he filed a complaint with the Consumer Financial Protection Bureau about his private loans.

Navient responded by sending him the school misconduct discharge application form, which he submitted in mid-April. On May 10, he received a denial notice. It said Navient “carefully considers a variety of factors in determining whether a private loan should be discharged” but did not specify why his claim was rejected.

Mr. Jean-Mastej said he had hoped Navient “would have some compassion” — especially since he has, over the years, already repaid the company nearly $17,000 for a loan of just less than $7,000. He still owes almost $4,000.

Scores of others are in limbo, awaiting a response. Thomas Carter learned about Navient’s program on a Reddit forum . Following the steps recommended there, he filed a consumer bureau complaint, then received an application form from Navient. He sent it in three weeks ago.

“My thoughts were, like, why is this such a secret?” said Mr. Carter, who attended the Art Institute of York, in Pennsylvania. “You had to go through all these hoops to get the application.”
